Although James Rhodes did not appear in Age of Ultron in the Iron Patriot persona, they did reissue the Titan Iron Patriot from Iron Man 3 under a generic "Avengers" label at the same time as that film's toy release. The paint scheme for this Iron Patriot was significantly different than in the Iron Man 3 film, so this repaint of an Age of Ultron War Machine is basically a "what if Iron Patriot were in Age of Ultron?" figure.
